Terms of Service

Please read these terms carefully before using Quote My Build.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Quote My Build ("we", "us", "our") governing your access to and use of the quotemybuild.co.uk website and services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Service under applicable law
  • Be a resident of the United Kingdom or have a legitimate business reason to use UK-based construction quoting software

By using the Service, you represent and warrant that you meet all eligibility requirements.

3. Description of Service

Quote My Build provides a cloud-based platform for construction professionals, tradespeople, and contractors to:

  • Create and manage project quotations and invoices
  • Configure and price construction services using our configurator tool
  • Store client information and project details
  • Schedule projects and sync with Google Calendar
  • Upload, store, and process business receipts
  • Manage team members and company settings
  • Generate PDF documents for quotations and invoices
  • Send emails to clients with quotations and invoices

4. User Accounts

4.1 Account Creation

To access most features of the Service, you must create an account. You may register using your email address and password or through third-party authentication providers (Google, Facebook).

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised access or security breach

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

5. Companies and Teams

The Service allows you to create companies and invite team members. As a company owner, you:

  • Are responsible for managing team member access and permissions
  • Must ensure all team members comply with these Terms
  • Are responsible for all actions taken by team members under your company account
  • Have the authority to remove team members at any time

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal or unauthorised purpose
  • Violate any applicable laws, regulations, or third-party rights
  • Upload or transmit viruses, malware, or other malicious code
  • Attempt to gain unauthorised access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Impersonate any person or entity
  • Collect or harvest user data without consent
  • Use the Service to send spam or unsolicited communications
  • Upload content that is defamatory, obscene, or infringes intellectual property rights

7. User Content and Data

7.1 Ownership

You retain all ownership rights to the content and data you upload to the Service ("User Content"), including project information, client details, receipts, and documents.

7.2 Licence Grant

By uploading User Content, you grant us a limited, non-exclusive, royalty-free licence to store, process, display, and transmit your User Content solely to provide the Service to you.

7.3 Client Data Responsibility

You are solely responsible for:

  • Obtaining any necessary consents from your clients before storing their personal data on our Service
  • Ensuring your use of client data complies with applicable data protection laws (including UK GDPR)
  • The accuracy and legality of all client data you upload
  • Responding to data subject requests from your clients

7.4 Data Processing

When you upload receipts or documents, we may use optical character recognition (OCR) technology to extract information. This processing is performed to provide the Service and is subject to our Privacy Policy.

8. Pricing and Materials Data

The Service may include estimated material prices sourced from publicly available information. You acknowledge that:

  • Material prices are estimates only and may not reflect current market prices
  • We do not guarantee the accuracy, completeness, or timeliness of pricing data
  • You are responsible for verifying prices with suppliers before providing quotations to clients
  • We are not liable for any losses arising from reliance on pricing data

9. Third-Party Integrations

The Service integrates with third-party services including:

  • Google Calendar: For schedule synchronisation (requires your authorisation)
  • Google/Facebook Authentication: For account sign-in

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Intellectual Property

10.1 Our Rights

The Service, including its original content, features, functionality, design, and underlying technology, is owned by Quote My Build and is protected by copyright, trademark, and other intellectual property laws.

10.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes in accordance with these Terms.

10.3 Restrictions

You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Remove any copyright, trademark, or proprietary notices
  • Sublicence, sell, rent, or lease the Service to third parties

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Quote My Build, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any User Content you upload or transmit
  • Your relationships with your clients

14. Termination

14.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature (if available). Upon termination, you will lose access to the Service and your data.

14.2 By Us

We may suspend or terminate your account immediately, without prior notice or liability, if:

  • You breach these Terms
  • We are required to do so by law
  • We discontinue the Service
  • Your conduct may harm our reputation or other users

14.3 Effect of Termination

Upon termination:

  • Your right to access and use the Service will immediately cease
  • We may delete your account and data in accordance with our Privacy Policy
  • Provisions of these Terms that should survive termination will remain in effect

15. Modifications to Service and Terms

15.1 Service Changes

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

15.2 Terms Changes

We may revise these Terms from time to time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

17.5 No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us.
